Colorado Non-Compete Threshold

The minimum salary threshold for non-competes in Colorado is based on the salary threshold for highly compensated workers. In 2025, the salary threshold for non-competes is $127,091/year and $76,254.60/year for non-solicits. To be enforceable, the employee subject to the non-compete or non-solicit must meet the requisite salary threshold, and the non-compete and/or non-solicit must be no broader than reasonably necessary to protect the employer’s legitimate interest in protecting trade secrets. In addition, proper notice of the restrictive covenant must be given to the employee.
